Do not delay — act immediately. Illegal occupation (adverse possession) becomes harder to challenge over time. The Remedium’s lawyers will first send a legal notice, then file a suit for recovery of possession or an injunction restraining further occupation, and simultaneously approach the District Magistrate for action if criminal trespass is involved. Time is critical in these matters.

A sale agreement (Agreement to Sell) is not mandatorily registerable but is highly recommended. The actual sale deed, however, must be compulsorily registered under the Registration Act, 1908. Failure to register a sale deed makes the transaction legally unenforceable. We strongly advise registration of all key property documents.

Complaints can be filed for builder-related violations including delayed possession, failure to provide promised amenities, structural defects, deviation from approved plans, non-registration of the project with RERA, and refusal to execute the sale deed. Both individual buyers and groups of buyers (in the same project) can approach UP-RERA.
